GymOS provides an internet-hosted, multi-tenant gym management software-as-a-service (SaaS) platform. Features include, but are not limited to:

We endeavor to provide uninterrupted dashboard service, but reserve the right to temporarily suspend services for scheduled upgrades, server patches, or emergency system maintenance.

To use GymOS, you must create a subscriber account under the following terms:

• Eligibility: You must be at least 18 years of age and hold legal capacity to bind a business or gym to a commercial agreement.
• Accuracy: You must provide true, complete, and accurate registration information (business name, primary contact, billing setup).
• Security: You are solely responsible for maintaining the confidentiality of your login credentials (email and passwords). Any activities occurring under your tenant workspace are your sole responsibility.
• Unauthorized Use: You must notify us immediately at `contact.gymos@gmail.com` of any breaches of security or unauthorized dashboard sessions.

Usage of GymOS is subject to subscription fees under the following parameters:

As a user of the platform, you agree NOT to:

• Use GymOS for any illegal, regulatory-violating, or unauthorized business purposes.
• Attempt to breach or bypass database isolation, Row-Level Security (RLS), or authentication tokens.
• Send spam, unsolicited messages, or unauthorized marketing materials via integrated transactional SMS/email services.
• Reverse-engineer, decompile, or copy the frontend layouts, styling, design systems, or proprietary mechanisms of GymOS.
• Upload files containing viruses, Trojan horses, malware, or destructive payloads to our database storage nodes.

Your Data (Tenant Ownership):

You retain complete, exclusive intellectual property rights and ownership over all information, member files, payment details, and text that you upload to your GymOS workspace. You grant GymOS a limited, worldwide, royalty-free license to store, process, back up, and format this data solely for the purpose of operating the dashboard and providing services.

Our Intellectual Property (GymOS Ownership):

All components of the GymOS software (including but not limited to the codebase, Vite design systems, logo designs, icons, database structures, templates, sitemaps, and algorithms) are protected by copyright and intellectual property laws of India and international treaties. They remain the exclusive property of GymOS.

GymOS is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding performance, availability, error-free operation, or correctness.

To the maximum extent permitted by law, GymOS, its developers, partners, and affiliates, shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes but is not limited to: loss of profits, loss of gym revenue, loss of member data, goodwill, or alternative replacement service costs.

In no event shall our cumulative liability for all claims arising from this agreement exceed the total subscription fees paid by you to GymOS in the twelve (12) months preceding the event that gave rise to the liability.

You agree to defend, indemnify, and hold harmless GymOS, its developers, subprocessors, and contractors, from and against any claims, losses, damages, liabilities, costs, or expenses (including legal fees) arising from:

• Your violation of these Terms and Conditions.
• Disputes arising between you and your gym members (including refund claims, personal injury, or billing complaints).
• Compliance errors related to your business filings, taxes (GST), or consumer communication regulations.

These terms remain active as long as you maintain an account or subscription with GymOS.

We reserve the right to immediately terminate or suspend your account and access to the platform, without prior notice or liability, if:

• You fail to pay subscription invoices when due.
• You violate these terms, including acceptable use parameters.
• We detect fraudulent activity or unauthorized attempts to access server cores.

Upon termination, your right to use the platform ceases. You can request a CSV/Excel backup of your member roster within 30 days of termination. After 90 days, all backup databases belonging to the tenant will be permanently deleted.

These Terms and Conditions shall be governed by, and construed in accordance with, the laws of the Republic of India.

Any dispute, controversy, or claim arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the competent courts of India, to the exclusion of all other courts.
